By creating an account or using Ethos Social ("Ethos", "we", "our", or "us"), you agree to these Terms of Use. If you do not agree, please do not use our services.
You may use Ethos Social only for lawful purposes and in accordance with all applicable laws and regulations. You are responsible for all activity that occurs under your account.
Ethos Social provides a platform where users can support verified talent and access platform utilities. You acknowledge and agree that:
(a) Verification Required. Identity verification is a baseline requirement to create and maintain an ethos account and to access any partner venue, event, platform, or integration that uses ethos for verified entry or authentication. You may not bypass, defeat, or circumvent the verification process.
(b) Verification Methods. ethos verifies identity through one of multiple methods, including (i) the Apple Verify with Wallet API for users with a U.S. driver's license or state ID in Apple Wallet on iOS, (ii) the Verify with Google Wallet API for users with a U.S. driver's license or state ID in Google Wallet on Android or a supported browser, (iii) direct integration with the Texas Department of Public Safety for Texas residents, (iv) NFC-based passport reading via iOS Core NFC or Android NFC for U.S. passport holders.
(c) Biometric Information Consent. In all verification flows, ethos captures a live selfie and compares it to the photo on your government ID to confirm you are the person presenting the document. By creating an ethos account, you provide express written consent to the collection and processing of your biometric information solely for this purpose, consistent with the Texas Capture or Use of Biometric Identifier Act (CUBI), the Illinois Biometric Information Privacy Act (BIPA), and other applicable biometric privacy laws. Details on retention and discard of biometric information are in our Privacy Policy.
(d) Accuracy of Information. You agree that all identity information you provide or transmit through ethos is true, accurate, and yours. Providing false, stolen, or fraudulent identity information is grounds for immediate account termination and may result in legal action.
(e) One Account Per Person. ethos enforces one verified identity per person. You may not create multiple accounts, use another person's identity, or attempt to verify with credentials that are not your own.
(a) The Credential. Upon successful verification, ethos issues you a verified identity credential ("ethos ID") that represents you as a real, unique, verified human within the ethos ecosystem.
(b) Ownership and Use. Your ethos ID is personal to you, non-transferable, and may only be used by you. ethos retains the right to suspend, revoke, or terminate any ethos ID for violations of these Terms, the Community Guidelines, or applicable law.
(c) Sign in with ethos. When you authenticate to a partner platform using Sign in with ethos, ethos shares only the minimum information necessary to confirm your verified status to that partner. We do not share your underlying identity data with partners unless you explicitly authorize it. Your relationship with the partner platform is governed by that partner's own terms; ethos is not responsible for the partner's conduct, products, or services.
(d) Revocation. ethos reserves the right to revoke or invalidate an ethos ID at any time if we determine the underlying verification was fraudulent, the user has violated these Terms, or revocation is required by law. Revoked credentials will no longer be accepted at partner venues or platforms.

ethos may suspend or terminate your account at any time for violations of these Terms, suspected fraud, harm to other users, or as required by law. You may terminate your account at any time by contacting help@ethos.social.
The Services are provided "as is" and "as available," without warranties of any kind, express or implied. ethos does not warrant that the Services will be uninterrupted, error-free, or that verification results will be infallible.
To the maximum extent permitted by law, ethos, Unwind, Inc., and our officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services.
You agree to indemnify and hold harmless ethos, Unwind, Inc., and our officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Services will be resolved through binding arbitration administered by the American Arbitration Association in Austin, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality matters. You waive any right to participate in a class action or class arbitration.
We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Services after a change constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ethos. If any provision is held unenforceable, the remaining provisions will remain in full effect.
